In a surprising new admission that could reignite an old controversy, Marion County’s top lawyer says that the county’s dangerous dog law is unconstitutional.
County Attorney Guy Minter wrote in court documents filed Thursday (03/10/2011) that its definition of a dangerous dog conflicts with that found in state animal-control laws – and therefore the local definition is “invalid.”… his concession most likely means the county will lose a lawsuit filed last April challenging the constitutionality of [the ordinance]…A hearing in that case is scheduled for March 18.
